Hello,

I’m a NC driver. Recently I got a speeding ticket ( 79 in a 65 zone)
in Montgomery County of Virginia. I already had speeding ticket ( 57
in 45 zone ) approx. 2 years ago in NC for which I got PJC[ Prayer
for justice …. i.e. I did not get any DMV or insurance Points ].

Just wanted guidance as to what are my best options to handle this
ticket so that I have no/minimal impact on my DMV/Insurance records.
If anyone have a reference for good attorney who can help me out
here , please let me know. I also have few questions.

1) How many points ( Insurance & DMV ) do I get for this ticket
2) As now , I got my 2nd traffic offence in less than 3 year since
my last PJC, will I get points for my NC ticket as well?

Please help me out here.. Thanks in advance..

Yes, you get points for a Virginia ticket.

I used to do what you are doing, try to handle it myself, but, the smartest
thing to do is get a lawyer. They know all the options and they know how to
work the court system, which judges are the most leniant, etc.

This is the best advice. And don't worry about finding one, it won't
be long before lawyers from up there are writing you offering their
services.

FYI, They are stricter in VA than in NC. You can't waltz into court
and get a basically automatic plea to 9 over, like you can in NC, as
several people I know have discovered to their chagrin.

And when the violation gets reported back from VA, NCDMV will take
action as if it had happened in NC. For example, more than 15 over
they will suspend your license -- you'll get a letter demanding that
you surrender it (I know two people this has happened to). Also, no
matter what the speed limit, more than 75 mph can get a suspension
too, yes, 76 in a 70 can cost your your license, for example, so the
rule isn't just "less than 10 over and you're OK". (Note, when I
assert this people generally don't believe me but read this:
http://www.ncdot.org/dmv/driver_services/drivershandbook/chapter3/suspensions.html).

So it's definitely worth your while to hire a local lawyer who knows
the courts up there to represent you.

Will the ticket come back? I don't know anyone who's gotten one in
Virginia recently, but years ago it was spotty, sometimes they came
back sometimes not, with higher speeds increasing the likelihood of it
coming back. Up to you how much you want to chance it.

At one time in the past, not sure what the rule is today, is that you
had to exceed the limit by 15 mph over 55 mph (that number may have been
upped) before states who are members of the "Non Resident Violator
Compact" (and VA and NC are members) would report the violation to one's
home state.

Yes I think I should have fought my 1st ticket rather than taking
PJC... Learning from mistake...

going to hire a lawyer this time... Didn't get any letter so far..
This has been a 3rd week since it happened.. So would welcome any
references..

Also , What tickets/convictions are not reported to NC DMV?
